“Marathon ARCO Rewards,” also known as “Marathon Rewards” and “ARCO Rewards,” is a partner rewards program owned by Marathon Petroleum Company LP. This Privacy Policy describes the types of personal information we collect in connection with Marathon ARCO Rewards, how we use the information, with whom we may share it and the choices available to you regarding our use of the information. This Privacy Policy applies to personal information we collect online (for example, on our websites or mobile apps that link to this Privacy Policy) and offline (for example, at our program partners’ fuel stations). We also describe measures we take to protect the information and how you can contact us about our privacy practices.

This Privacy Policy applies only to Marathon Petroleum Company LP and does not address the privacy practices of our program partners, such as third-party jobbers, dealers, franchisees and brands.  The privacy practices of our program partners may be subject to their own privacy notices describing how they process personal information.

Information We Obtain

We obtain personal information about you in various ways, such as when you use your Marathon ARCO Rewards account, visit our websites or use our mobile apps (collectively, the “Services”). We also may obtain personal information about you offline, such as when you call, mail or fax us, or use your Marathon ARCO Rewards account with one of our program partners at a fuel station. The types of personal information we may obtain include:

  • Contact information, such as name, telephone number and postal and email address;
  • Account information, such as login information, account preferences and other account details;
  • Payment information, including name, billing and delivery address, and payment card details;
  • Demographic information, such as date of birth and other information regarding your age or eligibility for age-restricted products, offers, or promotions;
  • Location information, such as precise geolocation as described in the Automated Data Collection section below;
  • Device and online activity information, as described further in the Automated Data Collection section below;
  • Commercial information, such as information relating to your purchases and transactions at our program partners’ fuel stations, including your purchase history and inferences about your preferences, tendencies and interests (for example, product or services recommendations);
  • Information about your visits to and purchases at our program partners’ fuel stations;
  • Social media information, such your social media handle and other account or profile information we receive from third-party social media platforms; and
  • Communications, interactions, and other information you choose to provide, such as through our automated chat feature, calls, emails or other communications, social media pages, surveys, registrations and sign-up forms.

Automated Data Collection

When you use our Services or open our emails, we may obtain certain information by automated means, such as cookies, web beacons (including pixels and tags), scripts, server or device logs, and other technologies. These technologies help us (1) remember your information so you do not have to re-enter it; (2) track and understand how you use and interact with the Services; (3) tailor the Services around your preferences; (4) measure the usability of the Services and the effectiveness of our communications; (5) authenticate your identity, protect against fraud and provide our products and services; and (6) otherwise manage and enhance our products and services, and help ensure they are working properly.

We may use these automated technologies on the Services to collect information about your device, location, browsing actions, and usage patterns. We obtain information about your device and web browser in this manner such as your device IP address, location information, unique device identifiers, device type and model, device characteristics and settings, browser settings and characteristics, operating system type and version, language and country preferences, battery and signal strength, usage statistics, referring emails and web addresses, and other application details. We also may obtain information about your interactions with our Services, such as pages visited, links clicked, features used, dates and times of usage, session information, and other information about your use of our Services. In addition, when you use our automated chat feature, both we and our service providers may record and maintain a transcript of your chat.

Through automated technologies, we may track information about your online activities over time and across third-party websites and apps. Your browser may tell you how to be notified about certain types of automated collection technologies and how to restrict or disable them. For example, your device’s operating system or web browser may provide you with a notification when an app attempts to collect your precise geolocation. Please note, however, that without these technologies, you may not be able to use all of the features of the Services. For mobile devices, you can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device.

Our mobile app may collect information about the location of your mobile device or computer (such as GPS coordinates or approximate location) based on your device settings. For example, our mobile app may use geolocation information to help you find the nearest station to your current location, notify you about nearby local offers, or support your use of mobile payments. For most mobile devices, you are able to withdraw your permission for us to collect this information by using the device settings. Some features within our Services may not be available or may not fully function if you turn off location services.

How We Use the Information We Obtain

The purposes for which we collect and use personal information depends on your interactions with us and our program, products and services. We may use the personal information we obtain for the following purposes:

  • Provide Our Program, Products and Services. We use personal information to provide, tailor, and improve our program, products and services, such as to enroll you in and administer your participation in Marathon ARCO Rewards, manage your accounts, and process and fulfill transactions in connection with our program partners’ products and services.
  • Manage Our Relationship With You. We use personal information to manage our relationship with you and communicate with you, including providing you with offers and other communications about the products and services of our program partners, responding to inquiries, offering customer support, personalizing your experience with our products and services, and administer participation in surveys, sweepstakes, promotions or other programs.
  • For Marketing and Advertising. We use personal information to advertise and market our products and services or those of our program partners.
  • Support our Business Operations. We use personal information to support our business operations, including to:
  • Perform analytics and market, trend or statistical research;
  • Compile, anonymize or aggregate personal information for our business purposes;
  • Operate, evaluate and improve our business (including developing new products and services; improving and analyzing our products and services; managing our communications; and performing accounting, auditing and other internal functions);
  • Maintain and enhance the safety and security of our products and services, prevent misuse and troubleshoot technical issues;
  • Verify your identity and protect against fraud and other criminal activity, claims and other liabilities;
  • Verify eligibility for age-restricted products, offers, promotions, and advertising where permitted by applicable law;
  • Exercise our rights and remedies and defend against legal claims; and
  • Comply with and enforce applicable legal requirements, relevant industry standards and Marathon policies, including the program’s Terms & Conditions.

We also may use the information in other ways for which we provide specific notice at the time of collection. To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

Third-Party Analytics Services

We may use third-party analytics services on the Services, such as Google Analytics. The providers of these analytics services use technologies such as cookies and web beacons to help us analyze your use of the Services. The information collected through these means may be disclosed to or collected directly by these services. Interest-Based Advertising

You may see our ads on other websites because we use third-party ad services on our Services. Through these ad services, we can tailor our messaging to individuals considering demographic data, inferred interests and browsing context. These ad services track information about your online activities over time and across third-party websites and apps by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other similar technologies. These ad services may collect data about your device (such as unique identifiers) and online activity data about visits to websites and apps that participate in these services, such as the pages or ads you view and the actions you take on the websites or apps. This data collection takes place both on our Services and on third-party websites and apps that participate in these ad services. These ad services use this information to show you ads that may be tailored to your individual interests. This process also helps us track the effectiveness of our marketing efforts.

We also may share personal information we collect through our Marathon ARCO Rewards program and at our program partners’ fuel stations (such as purchase information) with certain advertising services, brands and other marketing partners in order to provide you with more tailored offers. The personal information shared with these third parties may include name and contact information, commercial information, device data, online activity information, location information, and interests and preferences.

The sharing of personal information described above may be considered a “sale” or processing of personal information for targeted advertising under applicable law. Depending on where you reside, you may have the right to opt out of the sale of your personal information or processing of your personal information for targeted advertising. Information We Share

We share the categories of personal information described above in the following ways:

  • Affiliates. We may share the information we obtain about you with our affiliated companies for the purposes described in this Privacy Policy.
  • Program and Marketing Partners. We may share personal information with our program partners, brands, and other marketing partners to provide the program, including to provide you with offers and promotions. Because Marathon ARCO Rewards is a partner rewards program, by participating in Marathon ARCO Rewards, you are intentionally disclosing your personal information or interacting with all the participating program partners, including participating Marathon affiliates, dealers and jobbers.   • Vendors. We also may share the information we obtain about you with third-party vendors and other entities to perform services on our behalf, such as providers of technology, communications, payment processing, billing, advertising, marketing, age-verification, and compliance-related services. We also may share your personal information with social media platforms if you use those services to connect with us or in connection with services provided to us.
  • Business Transfers. We reserve the right to transfer any personal information we have about you in the event we sell or transfer all or a portion of our business or assets (including in the event of a merger, acquisition, joint venture, reorganization, divestiture, dissolution or liquidation).
  • Others. We may disclose personal information (1) if we are required to do so by law or legal process, such as a court order or subpoena; (2) in response to requests by government agencies, such as law enforcement authorities; (3) to establish, exercise or defend our legal rights; (4) when we believe disclosure is necessary or appropriate to prevent physical or other harm or financial loss; (5) in connection with an investigation of suspected or actual illegal activity; or (6) otherwise with your consent or as directed by your representative.

We do not intend to share contact information obtained from short code messages with third parties for their own direct marketing purposes.

Your Rights and Choices

We offer you certain choices in connection with the personal information we collect from you. To update your preferences, limit the communications you receive from us, or submit a request, please contact us as indicated in the How to Contact Us section of this Privacy Policy. You can unsubscribe from our marketing mailing lists by using the “Unsubscribe” option in our emails or texting “stop,” “quit,” “end,” “revoke,” “opt out,” “cancel,” or “unsubscribe” in response to our SMS messages. You also may update certain of your account details and settings by logging into your account on the Services. Depending on your state of residence, you may have the right to:

  • Access: You may have the right to request (1) confirmation of whether we process your personal information and (2) access to the personal information we maintain about you, including a copy provided in a portable format. Depending on your state of residence, you also may have the right to request information about the categories of third parties to whom we disclose personal information.
  • Correction: You may have the right to request that we correct the personal information we maintain about you, if that information is inaccurate.
  • Deletion: You may have the right to request that we delete certain personal information we have collected from you.
  • Opt Out of Sale of Personal Information or Processing for Targeted Advertising: You may have the right to opt out of the sale of your personal information or the processing of your personal information for targeted advertising purposes.

You may designate an authorized agent to submit a rights request on your behalf. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your deletion or correction request. If you request access to, correction of or deletion of your personal information, we may verify your identity by requiring you to authenticate your email address or providing information about your prior interactions with us. If you submit a request through an authorized agent, we may ask for your written permission or a power of attorney. Where you provided your authorized agent with a written permission, we may require that you also verify your identity. How We Protect Personal Information

We maintain administrative, technical and physical safeguards designed to protect personal information against accidental, unlawful or unauthorized access, destruction, loss, alteration, disclosure or use.

Children’s Privacy

The Services are designed for a general audience and are not directed to children. In connection with the Services, we do not knowingly solicit or collect personal information from children under the age of 16. If we learn that we have collected personal information from a child under age 16, we will either seek parental consent or promptly delete that information. If you believe that a child under age 16 may have provided us with personal information, please contact us as specified in the How to Contact Us section of this Privacy Policy.

Links to Third-Party Services and Features

For your convenience and information, the Services may provide links to other online services (such as websites or social media platforms), and may include third-party features such as apps, tools, widgets and plug-ins. These online services and third-party features may operate independently from us. The privacy practices of the relevant third parties, including details on the information they may collect about you, are subject to the privacy statements of these parties, which we strongly suggest you review. To the extent any linked online services or third-party features are not owned or controlled by Marathon, we are not responsible for these third parties’ information practices.

Updates to Our Privacy Policy

We may update this Privacy Policy from time to time and without prior notice to you to reflect changes in our personal information practices. We will indicate at the top of the policy when it was most recently updated.

This California Consumer Privacy Statement supplements the Marathon ARCO Rewards Privacy Policy and applies solely to personal information collected about California consumers in connection with Marathon ARCO Rewards. This California Consumer Privacy Statement applies only to Marathon Petroleum Company LP and does not address the privacy practices of our program partners, such as third-party jobbers, dealers or franchisees.  The privacy practices of our program partners may be subject to their own privacy notices describing how they process personal information. 

This California Consumer Privacy Statement uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020) and its implementing regulations (collectively, the “CCPA”).

Notice of Collection and Use of Personal Information

We may collect (and may have collected during the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement) the following categories of personal information about you:

  • Identifiers: identifiers such as a real name, alias, postal address, unique personal identifier (such as a device identifier; cookies, beacons, pixel tags, mobile ad identifiers, and similar technology; customer number, unique pseudonym, or user alias; telephone number and other forms of persistent or probabilistic identifiers), online identifier, IP address, email address, account name, and other similar identifiers;
  • Additional Data Subject to Cal. Civ. Code § 1798.80: credit card number, debit card number, or other financial information;
  • Protected Classifications: characteristics of protected classifications under California or federal law, such as age;
  • Commercial Information: commercial information, including records of personal property, products or services purchased, obtained, or considered, and other purchasing or consuming histories or tendencies;
  • Online Activity: Internet and other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding your interaction with websites, applications or advertisements;
  • Geolocation Data;
  • Sensory Information: audio, electronic, visual, and similar information; and
  • Inferences: inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

We do not collect or process sensitive personal information for purposes of inferring characteristics about consumers.

We may use (and may have used during the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement) your personal information for the purposes described in the Marathon ARCO Rewards Privacy Policy and for the following business purposes:

  • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytics services, providing storage, or providing similar services;
  • Providing advertising and marketing services;
  • Auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
  • Short-term, transient use, such as nonpersonalized advertising shown as part of your current interaction with us;
  • Helping to ensure security and integrity;
  • Undertaking activities to verify or maintain the quality or safety of our services or devices and to improve, upgrade, or enhance them;
  • Debugging to identify and repair errors; and
  • Undertaking internal research for technological development and demonstration.

To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.

Retention of Personal Information

We will retain your personal information for the time period reasonably necessary to achieve the purposes described in the Marathon ARCO Rewards Privacy Policy and this California Consumer Privacy Statement, or any other notice provided at the time of collection, taking into account applicable statutes of limitation and records retention requirements under applicable law.

During the 12-month period prior to the Last Updated data of this California Consumer Privacy Statement, we may have obtained the personal information about you listed above from the following categories of sources:

  • Directly from you, such as when you enroll and participate in Marathon ARCO Rewards.
  • Your devices, such as when you use our Services.
  • Our affiliates and jobbers.
  • Vendors who provide services on our behalf.

  • Operating systems and platforms.

Sale or Sharing of Personal Information

We may share your personal information by allowing certain third parties (such as online advertising services) to collect personal information via automated technologies on our websites and apps for cross-context behavioral advertising purposes. We also may share personal information we collect through our Marathon ARCO Rewards program and at our program partners’ fuel stations with certain advertising services, brands and other marketing partners in order to provide you with more tailored offers. These kinds of sharing may be considered sales of personal information or sharing of personal information for cross-context behavioral advertising purposes under the CCPA. You have the right to opt out of these types of disclosures of your information.

We may sell or share for cross-context behavioral advertising purposes (and may have sold or shared during the 12-month period prior to the Last Updated date of this California Consumer Privacy Statement) the following categories of personal information about you to online and offline advertising services:

  • Identifiers;
  • Commercial Information;
  • Online Activity; and
  • Inferences.

You have the right to opt out of this disclosure of your information, as detailed below. We do not have actual knowledge that we sell or share the personal information of minors under 16 years of age.

California Consumer Privacy Rights

You may have certain choices regarding your personal information, as described below.

  • Access: You have the right to request, twice in a 12-month period, that we disclose to you the personal information we have collected, used, disclosed, and sold and shared about you, including the categories of personal information collected, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you.
  • Correction: You have the right to request that we correct the personal information we maintain about you, if that information is inaccurate.
  • Deletion: You have the right to request that we delete certain personal information we have collected from you.
  • Opt Out of Sale or Sharing: You have the right to opt out of the sale of your personal information or the sharing of your personal information for cross-context behavioral advertising purposes.
  • Shine the Light Request: You also may have the right to request that we provide you with (a) a list of certain categories of personal information we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year and (b) the identity of those third parties.

If you designate an authorized agent to make an access, correction, deletion, or opt out of sale or sharing request on your behalf, and for access, correction and deletion requests, we may require you to provide the authorized agent written permission to do so and to verify your own identity directly with us (as described below). Verifying Requests. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your deletion or correction request. If you have a Marathon ARCO Rewards account with us, we may verify your identity by requiring you to sign in to your account. If you do not have a Marathon ARCO Rewards account with us and you request access to, correction of or deletion of your personal information, we may require you to verify your email address or phone number in our records and/or provide any of the following information:

  • Contact information (such as name, email, phone number, and address); and
  • An indication of your prior contact with Marathon (such as status as participation in a focus group or survey, prior contact with customer service, or other contact).

In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.

Additional Information. You have the right to not be retaliated against if you choose to exercise any of your rights under the CCPA. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

Notice of Financial Incentive

Marathon ARCO Rewards allows you to earn rewards on qualifying purchases that can be redeemed for fuel purchases at participating Marathon or ARCO locations. When you participate in Marathon ARCO Rewards, you provide certain personal information for Marathon’s use, such as your name, date of birth, zip code, phone number, email address and information about your visits to and purchases from our program partners’ fuel stations. Please see the Information We Obtain section of the Marathon ARCO Rewards Privacy Policy for a full list of the personal information collected in connection with your Marathon ARCO Rewards account. We also may disclose some of the personal information we collect from you to certain advertising services, brands and other marketing partners in order to provide more tailored offers to you. The collection and disclosure of personal information is necessary for us to offer members certain Marathon ARCO Rewards benefits and offers.

You can opt in to Marathon ARCO Rewards by clicking “SIGN UP” at www.marathonrewards.com or www.arcorewards.com, by following the instructions on the pin pad at one of our stations or otherwise where we provide sign-up opportunities. You have the right to opt out of Marathon ARCO Rewards at any time and can do so by following the instructions available in your account. We generally do not assign a monetary value to the personal information we collect through Marathon ARCO Rewards. Based on a good-faith estimate, we believe the value received from that personal information is reasonably related to the value of the discounts, coupons and other benefits we offer in connection with the program, taking into consideration the costs related to maintaining the Marathon ARCO Rewards program. In order to provide you with Marathon ARCO Rewards benefits, we need to maintain your personal information. If you choose to delete your personal information, we may no longer be able to provide you with offers and promotions through Marathon ARCO Rewards.
